Once again a rather thin issue of the Snooze. In the general articles
section Frank Vest tells us about an encounter in a newsgroup, where
someone claimed that many fido-BBS's are dead. This in the article
"Not a 'Good Show, Mate'"
"Catcalls from the Cheap Seats" by Luke Kolin is this week entirely
dedicated to the poor Dutch kid that was framed by the FBI.
In the kitchen section Carol makes "Soy Onions". I guess those can
be made on the grill as well, if you want them as a side dish at the
grill party.
Finally, for the jokes section, we received a kiddy joke from
Warren Bonner. It's called "Cute".

Having heard of FidoNet for several years, I wanted to add FidoNet to
my BBS, so I went hunting for the information. I found a bbs that
carried fidonet echos so I spent a few days reading some of them.. I

but filthy mouths, flame wars, power struggles and god help a new
person or a female.. you will be shit on. A couple seemed to be ok,
but it looks to me like this network is dead for the avarage person.

In my opinion, this is sadly the case too often for those that might
want to join Fidonet. They search for information and find little.
When they finally do find a BBS to check out, it is like the above.
Why??
Probably many reasons. I'll just list my thoughts and everyone can
take it from there with flames and fights. :(
DEAD SYSOP:
Some Sysops are "missing in action". The BBS is there, but the Sysop
is not interested, doesn't have the time, plays on the Internet side
of his/her BBS or some other excuse and leaves the BBS run "just
because". The echos haven't been looked at, updated or whatever in
some time. The link to the Node might be gone and not noticed by the
Sysop who never logs into his/her BBS.
SYSOP/ADMINISTRATIVE ECHOS OPEN TO THE PUBLIC:
Don't laugh. I've visited BBSs that have echos open to the public that
should not be. The Sysop either doesn't realize that the echo should
not be in the public or doesn't know how to prevent access by the
public.
IN DEFENSE OF US ALL:
In all fairness, I can't lay all the blame on all of us or just the
above reasons. In my reply to this message in the newsgroup (of course
I replied :-) I mentioned that judging all of Fidonet by the,
apparently, one BBS called is not good. It would be much the same as
judging all of one country/nation by one citizen in that country.

Catcalls from the Cheap Seats

It is not often that this not so humble commentator gets dragged into
a defence of the US criminal justice system. However, considering the
outrage I've managed to provoke in Michiel van der Vlist, I would be
remiss if I didn't take a few extra steps in order to clear up the
matter of our Dutch friend Menno B and his fondness for little girls
who really are middle-aged FBI agents. (Is there a UseNet newsgroup or
Yahoo club for that fetish, or will I start my own?
alt.sex.fetish.fat.bald.feds!) Let us begin by getting a few things
out of the way right at the beginning, so that all of our readers are
clear on what happened. Only then can we discuss the real heart of the
matter.
First, Menno was not "framed". In English, the verb "to frame" implies
either that a picture or painting is placed within a frame, or that an
individual has been accused and convicted of a crime he did not
commit, by the active malfeasance of law enforcement or another party.
In no way can Michiel claim that Menno B has been framed. Did he not
communicate with the individual? Did he not intend to engage in sexual
relations with her, if she had in fact been a 14-year-old girl? Did he
not travel to the United States for that purpose? Did he not make
arrangements to meet this "girl"?
Fact is, by everyone's admission that's EXACTLY what Menno wanted to
do. If he was merely a hapless Dutch tourist seeing the Grand Canyon
one fine day who hadn't chatted on the Internet in his life, and the
chats were a fabrication of an FBI agent, that would be a case of our
subject being "framed". But that is not the case at all. Again, there
has been no dispute whatsoever on the facts of this case. To suggest
that Menno was framed is implying that American law enforcement had
twisted the details of the case. Considering that Menno himself agrees
to the facts, it is somewhat unreasonable for Michiel (and to that
extent, our Editor - shame on you, Bjorn!) to use the word "framed".
We may have disagreement over the tactics used by the FBI, but that's
a different argument which I'm more than happy to engage in later.
Now, before I'm painted as a deeply reactionary and unreasonable
father, let's discuss my daughter (and my non-existent son) for a few
moments. I recognise, instinctively, that at some point in her life
she will engage in sexual activity. Where Michiel and I disagree, is
the age at which such activity is appropriate. Now, clearly, at 14
months of age she is far too young to be involved or even interested
in such a thing. At eighteen, that's certainly going to be her
decision, not mine. All I can do is hope to influence her into making
appropriate choices that she will not regret at a later date. Where
things get sticky is at what age in between is sexual activity on her
part appropriate? Is it fourteen, as Michiel advocates? How about
thirteen? twelve? Maybe ten? How about eight years of age? What gives
Michiel the right to determine at what age parents such as myself lose
our responsibility to control certain aspects of our minor children's

behaviour? I certainly wouldn't want Dutchme n like Menno and Michiel
determining what age my daughter is allowed to engage in sexual
activity with an older man, any more than I'd want some pious Saudi
Arabian cleric to do so. I (and members of my community) have gotten
together through our elected representatives and passed a series of
laws regarding statutory rape and the use of minors for sexual
purposes.
It's interesting that Michiel refers to having sex with a
fourteen-year-old as being "technically" illegal, about the same as a
parking ticket, just after he discusses a recent move to lower the age
of consent to twelve years of age. He mentions that such activities
should be legal as long as the child "consents". What is consent? And
why is there an age of consent? Why is it that legally, a child of a
certain age cannot consent to sexual activity, even if he or she wants
to engage in it? Why? Because lawmakers, unlike Michiel, have the
intelligence and common sense to recognise that children are incapable
of making meaningful, thought out decisions in a large number of
situations. Under Michiel's interesting view of the world, a
40-year-old could promise to divorce his wife and marry a 14-year-old
and give her lots of money if she'd have sex with him. If she said
"yes", there would be no crime committed. Now, we both now that on its
face, such a promise is. Ahem... unlikely to be hono ured. However,
some children are more susceptible than others to unreasonable
propositions are. However, the child had freely and willingly
consented. Now, in Michiel's view, responsibility would shift onto
parents to protect their children by "instilling values" into them,
before they went out into a world where it was open season on them.
Michiel brings up the suggestion that is "what if it was my child that
was arrested for purchasing a firearm?" Well, it doesn't take a rocket
scientist to understand that firearm laws vary substantially from
country to country. If my 25-year-old son came to me and informed me
that he was travelling to a foreign country to purchase a firearm, I'd
ask him "Have you checked to see if this is legal? What permits do you
need?" Heck, I'd even ask him that if he wanted to purchase a firearm
from a neighbour or the local gun store. (Firearm regulation does
exist in the United States, despite popular opinion in foreign
countries.) I would also hope that my son, at 25 years of age, would
recognise the basic notion that there are a lot of laws in the world
that regulate your behaviour, and that there are consequences to
violating them. A cursory check of those laws might not be a bad idea,
especially with something as regulated as firearms (or sex with
minors).
As a parent, anything bad that happens to my children causes me pain
and grief. However, I am also mature and sensible enough to realise
that (like Michiel exhorts me to) I cannot protect my children from
everything the world throws at them. If my son lacks the common sense
at 25 years of age to realise that certain items (especially firearms)
are regulated and restricted, and ends up in legal difficulties
because of it, I have only myself as a parent to blame - or I shrug my
shoulders and say I've tried long enough to instil common sense in the
boy. At the very least, he should have had the presence of mind to ask
someone whose judgement he trusted (like, I hope, myself) before he
went ahead and did it.

It does beg the question, of course, of what Menno asked his mother or
father before he left for the United States. Did he tell them, "Hey
folks, I'm travelling to the United States to engage in sex with a
teenage schoolgirl I met on the Internet? Think that's a good idea?"
Did he tell anyone? I'm sure even someone as amoral as Michiel is
turning out to be would at least have had the common sense to suggest
that this might not be the smartest of ideas.
I don't anticipate getting much agreement with Michiel on these
points. Our laws recognise that, and they are different between the
Netherlands and the United States. Let's move on towards a more
interesting legal argument, the question of "intent". Menno's crime
was the intent to engage in sexual activity with a minor. I don't
think we have any disagreement that this is what he truly intended.
Michiel also concedes that the intended activity is a crime - all that
we have left is if it is valid for the United States to criminalise
intent, and was Menno's arrest "entrapment."
Let's deal with the notion of intent. Intent is not as simple as
Michiel claims it is - one cannot criminalise thought in a civilised
country. Deeds are another matter. Legally, intent is a collection of
actions from which a reasonable individual would infer that the
defendant truly intends to commit a crime. The example that Michiel
suggests is a red herring. It's not illegal in any part of the United
States for me to take a look at a young girl (or boy, were it to my
taste) and think impure thoughts of illegal activity. It never has
been illegal to do so. Now, were I to proposition a young child, that
would probably be a crime. What would certainly be a crime (even if
the child consents) is to take further actions in preparation of an
illegal act, like going back to my house or renting a motel room.
Again, the systems (and juries) are smart enough to recognise that a
thought isn't evidence in and of itself of a future criminal act; the
follow-up actions are what determine it. While w e cannot know what
was in Menno's mind the very instant he stepped off that plane, it's
reasonable to assume he wouldn't travel all the way to the US only to
change his mind in the instant before the FBI showed up. If anything,
I think Menno changed his mind the instant AFTERWARDS.
Does Michiel really believe that Menno did nothing wrong in the US? In
and of itself, Menno just stepped off of an aeroplane in the United
States. Fortunately, US courts and judges aren't nearly as wilfully
blind as Michiel would want them to be. They ask sensible, logical
questions. And they asked themselves, he intended to commit a crime
while in the Netherlands. Are his actions in the US consistent with
that previous intent? If he had a different reason to come to the
United States, he sure didn't claim so. Instead, he did exactly as he
said he was going to do when he was in the Netherlands. You see, the
law is smart enough to recognise that illegal acts are often composed
of many legal actions. They look at the big picture.
As an example, I may have a desire to see my boss dead. To think, "I'd
love to shoot him" is not criminal in and of itself. Were I to legally
purchase a firearm to do so, that too might not be criminal. There are
dozens of legal and acceptable reasons for me to purchase a firearm,
none of which are related to the assassination of my supervisor.
Again, that probably wouldn't be sufficient to have me arrested, let

alone convicted. Were I to show up at work with my gun, that would
probably be enough and if the police had been tipped off about my
intentions to shoot my boss, I'd be stopped, searched and arrested,
even though it is not a criminal act to carry a concealed weapon into
my workplace in this state. (I could be fired for doing so, but that's
not a criminal process.) A reasonable individual would conclude that I
had taken enough steps to transfer my initial desires into a likely
future action, even though ALL of my previous acts have been entirely
legal. That's what criminal inten t is all about. You can't claim that
until I actually pull the trigger no crime had been committed. That's
absurd.
It's also an entirely legitimate tactic for law enforcement to act as
a potential party to a crime. Let me take another example - America's
drug laws. In the Netherlands, the purchase and consumption of
marijuana is still "technically" illegal, but again, is similar to a
parking ticket. If Menno had conspired with an individual over the
Internet to purchase a small amount of marijuana within the United
States and import it into the Netherlands, would it be impossible to
arrest him because the other party (the FBI agent) acted under false
pretences, since he had no intentions of ever selling me any? If so,
the entire practice of law enforcement would come to a grinding halt -
law enforcement, in the course of undercover work, needs to act as a
"willing accomplice" in order to accumulate evidence of a current or
future crime.
Michiel claims that the authorities "provoked" a crime. How exactly
was Menno provoked? Did he not come up with the idea to engage in
sexual conduct with a minor? Did he not come up with the idea to
travel to the United States? Are we to believe that Menno was so
feeble-minded that he was talked into all of this by a smooth-talking
FBI agent, and didn't have the mental capacity to say no? If so, then
Michiel is a hypocrite of the first magnitude.
You see, by claiming such a defence, Michiel claims that Menno was a
twenty-five year old "kid" who was incapable of the mental
decision-making necessary to take responsibility for his own actions.
So, apparently 25 years old is too young to make decisions regarding
right or wrong, but children of half that age are perfectly capable of
engaging in informed decisions about having sex with older
individuals??? That's the most ridiculous thing I've heard yet. If
anything, to characterise Menno as an uninformed "kid" means that the
age of consent should be RAISED, not lowered, as 25 is obviously too
young to make serious decisions on one's own. If 25 is still a kid, 14
must be a baby.
If the crime had truly been "provoked" in a legal sense, that would be
entrapment. That would be the FBI agent propositioning Menno about
sex. That would be the FBI agent suggesting he come to the United
States. And you'd bet your bottom dollar that Menno's lawyer would
have been jumping up and down screaming entrapment at every
opportunity, especially since the chat transcripts are the key pieces
of evidence in this case. Why hasn't he done so? Because there's no
evidence to support such a notion. It seems that Michiel wants things
both ways - he wants 25 year olds to be guarded from the legal
consequences of committing crimes, but believes that children half

that age contain the judgement necessary to provide the informed
consent necessary to engage in sex. Sex with children without
consequences - how disgusting.
Now, I'll give Menno (or most likely, his attorney, since common sense
wasn't present in Menno's actions until legal counsel was retained)
some credit here. He's never suggested for a moment that what he did
was right, because it wasn't. He's never suggested entrapment, because
there is no evidence of that taking place. I'm sure that when Menno
was passing through US Immigration, he didn't say to the INS Inspector
"I'm here to sleep with an underage minor", because he knew that was
wrong. At every step, this individual was intending on committing a
crime, and his actions are entirely consistent with that. What's more
interesting to this commentator, as this story as developed, are the
extraordinary lengths that Michiel has gone to defend this individual.
Again, the FBI probably has better things to do than go after Dutch
paedophiles, but that's not the issue. If Menno had contained his
musings to dirty talk behind a keyboard in the Netherlands, that would
be just fine. He wouldn't be a rrested, because (to be honest) he
wouldn't be a threat to American children. The minute he demonstrated
his wherewithal to travel to the United States to follow up on his
propositions, he was a threat and deservedly arrested. To suggest he
was too young to appreciate the consequences of his actions clearly
indicates that a 14-year-old is certainly incapable of giving consent
to sexual activity.
Again, it's common sense. Want to sleep with minors? Don't come to the
United States - go to the Netherlands, where's it's pretty much legal
and the population will fight hard to defend your "right" to do so.

How to Submit an Article
If you wish to submit an article for inclusion in the Fidonews, here
are some guidelines, if you send it as an attached file; the preferred
method if you want reasonable control over how the published article
will appear in the Fidonews:
a) Plain ASCII text. If you could type it on your keyboard, it's
probably quite OK...
b) Put a title to the article. Put the title in two times. The first
time, on the first line, with an * before it. The second time, on
the second line, without the * and centered. This will help in the
format since the title with the * is removed and used in the index,
the second line will become the headline. On the third line, put
your name and FidoNet address, present or former. If former, you
may want to add some other address where you can be reached for
personal comments.
c) Deadline for article submission is Sunday, 12:00 UTC.
Help the Editor by following the above guides. Below are some subjects
and the file extension for the article as set in the configuration
file for the making of the Fidonews. Please help by putting the file
extension of the correct subject on the file name if known..
